DATAVEX LABS LTD, trading as Nivarela, is the controller of personal information processed for our store at nivarela.com. Contact contact@nivarela.com for privacy questions or requests.

Information we collect

  • Information you give us: name, contact details, delivery and billing addresses, order details, messages, account details and newsletter preferences.
  • Payment information: payment status, transaction references and details needed to process a purchase or refund. Payment providers process your full card details; please do not send card numbers by email.
  • Information from using the site: IP address, browser and device details, security logs, cookie preferences and interactions with our store. Optional analytics and advertising depend on your consent where required.
  • Information from service providers: payment confirmations, delivery updates and information needed to support your order.

Why we use it and our lawful bases

  • Contract: process purchases, payments, fulfilment, tracking, returns and order support.
  • Legal obligations: keep required transaction records and respond to lawful requests.
  • Legitimate interests: protect against fraud, keep the site secure, respond to non-order enquiries and manage or defend legal claims, balanced against your rights.
  • Consent: newsletter marketing and optional cookies or similar technologies where required. You can withdraw consent at any time.

Delivery and payment details are necessary to complete an order. Newsletter subscription is optional and is not a condition of purchase.

Who receives information

We share only information needed for the relevant purpose with our store platform Shopify, payment providers selected at checkout, fulfilment partners, carriers, order-management services such as DSers, technical service providers, and professional advisers or authorities where necessary.

Fulfilment partners receive the details needed to prepare and deliver your order. This may include partners outside the UK. We do not sell personal information for money. Where optional marketing or analytics tools operate on the site, their collection is governed by your choices and the relevant cookie information.

Shopify

Shopify hosts our store and processes information to operate checkout and other services. Shopify may also act as a controller for its own consumer services, depending on the features you use. Read Shopify's Consumer Privacy Policy and visit its privacy portal for those services.

Cookies and email marketing

Necessary technologies support functions such as your basket, checkout, security and privacy preferences. Optional analytics and advertising technologies are subject to the consent controls offered on the site. See our Cookie policy.

You can unsubscribe using the link in a marketing email or contact us. Order and service emails may still be sent because they relate to your purchase.

International processing

Shopify and fulfilment or technical providers may process information outside the UK, including in Canada, the United States and Asia. Where a restricted transfer requires safeguards, we use the applicable recognised arrangements, such as an adequacy decision or appropriate contractual safeguards. Contact us for information about the safeguards relevant to your data.

How long we keep information

We retain information for the purpose for which it was collected. Order and transaction records are retained as required for accounting, tax and legal claims. Support records are kept while needed to resolve the enquiry and any related dispute. Newsletter details are used until you unsubscribe; a minimal suppression record may be retained to respect that choice. Cookie lifetimes and preferences are described by the relevant provider and consent controls. We delete or anonymise information when it is no longer needed.

Your rights

Subject to the applicable conditions, you can request access, correction, deletion, restriction or portability of your personal information, object to processing based on legitimate interests, and withdraw consent. To make a request, email contact@nivarela.com. We may ask for information needed to verify your identity and will respond within the legally required period, normally one month.

You can complain to the Information Commissioner's Office (ICO). You do not have to contact us first, although we welcome the opportunity to help.

Security, children and other websites

We take appropriate measures to protect information, but no online system is completely risk-free. Our store is not directed at children, and we do not knowingly collect information from children for marketing. Contact us if a child has provided personal information. External websites have their own privacy policies.

Updates

We update this notice when our practices change and provide additional notice where required. The latest revision date appears above.
