Who You Are Buying From
This website is operated by Datavex Labs Ltd, trading as Nivarela. We are a private limited company registered in England and Wales under company number 17036825, with our registered office at Unit A3, Castle Road, Sittingbourne, England, ME10 3EW. Where these terms say “we”, “us” or “our”, they mean Datavex Labs Ltd. You can reach us at any time at contact@nivarela.com. We are not currently registered for VAT.
These Terms Apply to Every Order
By placing an order you accept the terms set out on this page, together with our Returns & Refunds policy, our Delivery information and our Privacy Policy, each of which forms part of your agreement with us. Please read them before you buy. We may update these terms from time to time; the version in force when you place your order is the version that governs it. You must be at least 18 years old to buy from this website.
How a Contract Is Formed
Placing an order is an offer to buy, not a concluded sale. The confirmation email you receive immediately afterwards acknowledges that we have your order; it does not yet create a contract. A contract comes into existence only when we email you to confirm that your order has been dispatched, and it covers the items named in that dispatch email alone. If we cannot fulfil an order, we will tell you promptly and refund any payment taken in full.
Products & Descriptions
We describe every product as accurately as we can, and the images on the site are intended to give a fair impression of the item. Colours can nonetheless vary between screens, and dimensions and capacities quoted by manufacturers carry small tolerances. Packaging is occasionally revised by suppliers without notice. Stock is finite and we may withdraw a product or limit the quantity available on a single order. Where a product has a specific limitation, such as a filter that needs periodic replacement or a capacity suited to a particular room size, we state it on the product page.
Prices & Payment
The price of a product is the price shown on its page at the moment you order, and includes all taxes applicable to it. Delivery is charged separately and is calculated at checkout, so the total shown before you confirm is the total you will be charged. Prices change from time to time, but a change never affects an order already placed. Payment is taken at checkout through our payment provider, and we never see or store your full card details. Very occasionally a pricing error slips through; if the correct price is higher than the one advertised, we will contact you before dispatching and you are free to cancel rather than pay the difference.
Delivery & Risk
We deliver within the United Kingdom only. Estimated delivery windows are shown on each product page and confirmed when your order is dispatched; they are estimates rather than guarantees, as the final stage of every journey is in a carrier's hands. Goods become your responsibility once they are delivered to the address you gave us, and ownership passes to you once we have received payment in full. Full details are on our Delivery page.
Cancelling & Returning
You have a legal right to cancel within 14 days of delivery, and we extend that to a 30-day return window as a matter of policy. The procedure, who pays return postage, and how refunds are calculated are all set out on our Returns & Refunds page, which forms part of these terms.
Your Rights as a Consumer
Under the Consumer Rights Act 2015, the goods we supply must be of satisfactory quality, fit for their purpose and as described. Nothing on this page limits those rights or any other right you have under English law, and nothing limits our liability for death or personal injury caused by our negligence or for fraud. Beyond that, our liability in connection with an order is limited to the price you paid for it, and we are not responsible for losses that were not foreseeable or that arise from using a product other than as intended by its manufacturer.
Using This Website
The text, images, layout and branding on this site belong to us or to our suppliers and may not be copied or reused commercially without our written permission. You agree not to misuse the site, attempt to gain unauthorised access to it, or use it for any unlawful purpose. We work to keep the site available and accurate, but we may suspend or change parts of it, and we do not promise it will always be uninterrupted or free of error.
Events Outside Our Control
We are not liable for delays or failures caused by events genuinely beyond our control, such as severe weather, carrier or supplier disruption, or interruption to the networks and services the site depends on. Where such an event occurs we will let you know and do what we reasonably can to limit the delay. If it becomes substantial, you may cancel the affected order and receive a full refund.
Complaints & Governing Law
If something has gone wrong, please write to contact@nivarela.com and we will look into it. We aim to reply within 72 hours on working days and to resolve matters without any need for formality. These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, though if you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
